Terms of Service

Please read these Terms of Service carefully before using Oysten Host Ghp services. By accessing or using our services, you agree to be bound by these terms.

intro. Introduction

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONSTITUTES A LEGALLY BINDING CONTRACT. BY CREATING AN ACCOUNT, PURCHASING A DOMAIN, OR USING ANY OF OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This Terms of Service Agreement ('Agreement') is entered into by and between Oysten Host Ghp, a proprietary firm registered in India ('Company,' 'Oysten Host Ghp,' 'we,' 'us,' 'our'), and you, the client, including your agents, users, employees, contractors, heirs, and assigns ('Client,' 'you,' 'your'). This Agreement governs your purchase and use of all services offered by Oysten Host Ghp through oystenhost.com, including but not limited to shared hosting, reseller hosting, WordPress hosting, Windows hosting, cPanel web hosting, business hosting, VPS, dedicated servers, email services, domain registration/transfer/renewal, SSL certificates, and related add-ons (collectively, 'Services').

If you do not agree to these terms, you must immediately cease using our Services.


1. Acceptance, Eligibility, and Account Registration

1.1. Legal Capacity

By using our Services, you represent and warrant that you are at least eighteen (18) years old and have legal capacity to enter into a binding contract. If you use the Services on behalf of an entity, you represent that you are authorized to bind that entity to this Agreement.


1.2. Binding Terms and Applicable Law

Your use of the Services constitutes acceptance of:
- This Agreement,
- Our Acceptable Use Policy (AUP) (Section 4),
- Our Privacy Policy,
- All applicable laws and regulations, including the Information Technology Act, 2000 (India), and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.


1.3. Accurate Registration Data (Mandatory)

You must provide true, accurate, current, and complete information ('Registration Data'), including:
- Full legal name,
- Verifiable physical mailing address,
- Primary, active email address,
- Valid, active mobile number registered to you (WhatsApp-enabled; see Section 2.2).


1.4. False/Incomplete Information

Providing false, fraudulent, incomplete, or outdated information is a material breach. We may suspend or terminate your account and Services immediately, without notice and without refund. Any funds in your account will be forfeited, and no data backups will be provided.


1.5. Changes to Registration Data

You must promptly update Registration Data when it changes. We may rely on your last provided details for all notices.



2. User Verification and Communications

2.1. Mandatory Verification (KYC)

We may verify your identity via automated and/or manual methods at any time. You agree to comply with verification requests, including providing government-issued photo ID (e.g., Aadhaar Card, Passport, Voter ID) and any supporting documents. Failure to comply by the stated deadline may result in immediate suspension or termination without refund.


2.2. Mandatory WhatsApp Number and Communications

- You must provide and maintain a valid WhatsApp-enabled mobile number.
- You consent to receive essential service communications via WhatsApp and email, including: security alerts, service notices, billing invoices and reminders, overdue notices, ticket updates, usage alerts, and AUP violation notices.
- You are solely responsible for monitoring and ensuring deliverability of these communications.


2.3. Electronic Communications Consent

You consent to receive contracts, notices, invoices, and other communications electronically. Electronic communications satisfy legal requirements for written communications.



3. Client Responsibilities

3.1. Account Security

You are solely responsible for safeguarding your credentials and all activities under your account. Notify us immediately of any unauthorized access. You are responsible for all actions taken via your account (whether by you or a third party).


3.2. Backup Responsibility

YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATA. Any backups we provide are a courtesy only and are not guaranteed (see Section 6). Oysten Host Ghp is not liable for data loss, corruption, or inability to restore data. Do not store personal backup archives within shared hosting accounts (prohibited under the AUP).


3.3. Licensed Software and Content

Use only legally licensed software, themes, plugins, and content. You are solely responsible for the legality, licensing, and security of any third-party components.


3.4. Compliance

You must comply with this Agreement, the AUP, applicable laws, and any plan-specific resource limitations.



4. Acceptable Use Policy (AUP)

Any AUP violation may result in immediate suspension or termination without notice or refund.

4.1. Prohibited Content & Activities

You may not host, transmit, or link to content or engage in activities that are:
- Illegal under Indian or international law (e.g., illegal pharmaceutical sales, unlicensed gambling, trafficking, distribution of pirated/copyrighted content).
- Harmful/abusive: defamatory, harassing, threatening, obscene or pornographic content (including any sexual content involving minors), or content inciting violence or hatred.
- Fraudulent/deceptive: phishing, deceptive schemes, 'get rich quick' scams, social engineering, identity theft.
- Infringing: trademark/copyright violations, including domains imitating famous brands (e.g., 'amazon-offers.in,' 'flipkart-deals.net') or confusingly similar marks.
- Malicious: malware, viruses, ransomware, trojans, keyloggers; hacking, cracking, brute-force scripts, DDoS, IP spoofing.
- Anonymization/exits: Tor exit nodes, open proxies, VPN exit nodes, or public relays on shared hosting.


4.2. Prohibited Technical Uses (Shared/Reseller Plans)

- Resource Abuse: Using 25% or more of system resources (CPU/RAM/I/O) for over 90 seconds.
- Cron/Scripts: Cron intervals less than every 15 minutes are not allowed; resource-intensive scripts and web scrapers that degrade server performance are prohibited.
- Archiving/Storage: Hosting multiple or large archive files (.zip, .tar.gz, .rar, etc.) or using hosting as a personal backup/file dump is prohibited. We may scan for and remove such files without notice.
- Databases: Database size must not exceed 250MB. MySQL queries running longer than 30 seconds are prohibited. Remote database connections from external applications are not allowed on shared hosting.
- File Hosting/Streaming: No file distribution, video/audio streaming platforms, or download-centric sites on shared plans.
- Background Services/Daemons: Persistent background processes, bots (spam/IRC), port scanners, crawlers, and indexers are not permitted.
- Insecure/Outdated Software: Repeatedly running outdated CMS/plugins/themes that pose a security risk may result in suspension.


4.3. Email and Anti-Spam

- Sending unsolicited/bulk email (spam) is strictly prohibited.
- Sending limits per hosting account: 20 emails per hour and 50 emails per day.
- Using mailboxes for file storage is prohibited.
- Marketing or newsletter campaigns must use a compliant dedicated email service.
- We may suspend accounts causing IP blacklisting or spam complaints.


4.4. Security

You must maintain secure code and configurations, apply updates promptly, and use strong passwords. Compromised accounts may be isolated or suspended to protect the network.


4.5. Reseller Responsibilities

Resellers must ensure their clients comply with this Agreement and the AUP. Resellers are responsible for client content and activity. Violations by downstream clients may result in suspension of the reseller account.



5. 'Unlimited' Hosting Policy

'Unlimited' plans provide unmetered disk space and bandwidth for normal operation of small to medium business websites. They are not intended for:
- Large enterprises or application workloads that need sustained VPS/Dedicated resources,
- Online storage/backup, media streaming, file archives, or download hubs.

We may apply fair use limits, restrict features, or require an upgrade if usage negatively affects server stability or other customers.


6. Backup and Data Loss Policy

6.1. Shared & Reseller Hosting

We perform complimentary, periodic backups (e.g., twice weekly) for disaster recovery only. Availability or completeness is not guaranteed. Do not store your own backup archives on your shared account. You are fully responsible for maintaining off-site backups.


6.2. VPS & Dedicated Servers

Unmanaged by default. No backups are taken unless you purchase a backup add-on. You are 100% responsible for backup strategy and data protection.


6.3. Restoration

If a backup exists, restoration may be attempted at our discretion. Restoration is not guaranteed and may incur fees (see Section 7.4).



7. Billing, Payments, Renewals, and Fees

7.1. Invoicing and Payment

- Invoices are generated prior to renewal and sent via email and WhatsApp.
- Services are prepaid. Prices and payment terms are subject to change with notice.


7.2. Late Payments

- Unpaid invoices on the due date may cause immediate suspension.
- Late fee: ₹10 per day on overdue invoices (or as stated on your invoice).


7.3. Termination for Non-Payment

- If payment is not received within 7 days after the due date, your account may be terminated and all data permanently deleted.


7.4. Restoration Fee

- If a backup exists, we may restore a terminated account at our discretion for a non-refundable fee of ₹1000. Restoration is not guaranteed.


7.5. Chargebacks/Disputes

- Initiating a payment dispute or chargeback may result in immediate suspension/termination and forfeiture of data.
- You are responsible for any chargeback-related administrative fees and recovery costs.


7.6. Taxes and Gateways

- Prices exclude taxes and payment gateway fees unless stated otherwise.
- Where applicable, refunds are processed net of gateway fees (see Section 8.1).



8. Cancellations and Refunds

8.1. Refund Eligibility Window

- For eligible hosting services, a refund minus 12% payment gateway fee is available if you submit a cancellation request via the client area within 48 hours of account activation.


8.2. Service Failure Condition

- A refund may be considered if you report a critical service failure via support ticket and we cannot provide a resolution or reasonable workaround within 24 hours of acknowledging the ticket.
- Excludes issues caused by your code, third-party software, or configurations.


8.3. Eligible Services

- Shared Hosting, Reseller Hosting, WordPress Hosting, Windows Hosting, cPanel Web Hosting, Business Web Hosting.


8.4. Non-Refundable Items

- Domain names (registration/renewal/transfer), SSL certificates, VPS, Dedicated Servers, third-party licenses, G-Suite/Google Workspace, Microsoft 365, combo plans, any product purchased with a promotional code, late/restoration fees, services suspended/terminated for AUP/TOS violations.


8.5. No Refund If

- You previously received a refund;
- You used abusive language or misbehaved with our staff;
- Your account was terminated for violation of this Agreement;
- Your Registration Data was false/incomplete.


8.6. Method of Refund

- Refunds are credited to the original payment method or as account credit at our discretion.



9. Uptime, Maintenance, and Support

9.1. Uptime

We target 99.9% uptime. This does not include downtime due to:
- Scheduled maintenance (advance notice where possible),
- Client-side errors (code, configuration, or third-party issues),
- Force Majeure (see Section 21),
- AUP/TOS violations or suspensions,
- External network events beyond our reasonable control.


9.2. Maintenance Windows

We may perform emergency or planned maintenance at any time to ensure security and stability.


9.3. Support Scope

- Standard support covers platform availability and server-side issues.
- We do not provide development, debugging, or custom code support unless purchased.
- Migrations are provided as a courtesy (when offered), not guaranteed, and may incur fees.



10. Suspension and Termination

10.1. Our Right to Suspend/Terminate

We may suspend or terminate Services at our sole discretion for any breach of this Agreement or harm to our network/customers.


10.2. Effect of Termination

Upon termination:
- All Services cease immediately,
- All data, files, emails, and databases are permanently deleted,
- No refunds are issued, except as expressly provided in Section 8,
- Any remaining funds may be forfeited for violations.


10.3. Data Retention

We are under no obligation to retain data post-suspension or termination.



11. Domain Name Services and ICANN Compliance

If you purchase domain-related services through us (whether we act as an ICANN-accredited registrar or as a reseller of an accredited registrar), you agree to comply with all applicable ICANN policies and registry rules.

11.1. Accurate Registrant Data (WHOIS)

- You must provide accurate, current, and complete registrant contact data (WHOIS) and keep it updated.
- Inaccurate or unverifiable data may lead to suspension, cancellation, or deletion of the domain.


11.2. Email Verification (ICANN RAA)

- ICANN requires verification of the registrant's email. Failure to verify within the registrar's specified timeframe (often within 15 days) may result in domain suspension until verified.


11.3. Registrant Rights and Responsibilities

- You acknowledge the ICANN Registrants' Benefits and Responsibilities and educational materials, available via ICANN's website.
- You are responsible for understanding domain lifecycle, renewal obligations, and transfer policies.


11.4. Domain Transfers

- Transfers require provision of the domain's EPP/Auth code and unlocking the domain.
- A 60-day transfer lock may apply after registration, transfer, or WHOIS registrant changes, per ICANN/registry rules.
- We may deny transfers in accordance with ICANN policy (e.g., UDRP dispute, non-payment, court order).


11.5. Renewal, Expiration, and Redemption

- You are solely responsible for timely renewal prior to expiry. We send renewal reminders as a courtesy only.
- Post-expiry, domains may enter grace and redemption periods per registry policy. Recovery during redemption incurs registry redemption fees plus our service fees at then-current rates. Recovery is not guaranteed.


11.6. WHOIS Privacy/Proxy Services

- If available and purchased, WHOIS privacy/proxy masks your WHOIS data. It does not provide anonymity against lawful requests, court orders, UDRP/URS proceedings, or abuse investigations. Privacy may be suspended or disclosed when required by law or policy.


11.7. Dispute Policies (UDRP/URS)

- You agree to ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP) and, where applicable, Uniform Rapid Suspension (URS). We will comply with all decisions and may lock, cancel, or transfer domains per such decisions or court orders.


11.8. Abuse, Illegal Use, and DNS

- Domains engaged in phishing, malware, botnets, or illegal activity may be suspended or disabled.
- We may share registrant data with registries, ICANN, law enforcement, or dispute providers when required.


11.9. No Refunds on Domains

- All domain registrations, renewals, and transfers are final and non-refundable once submitted to the registry, except where a transaction fails (e.g., already registered or premium pricing conflict), in which case you may select an alternative or receive a refund of the domain fee.



12. IP Addresses, DNS, and SSL

12.1. IP Addresses

Any IP address assigned to you remains our property or that of our upstream provider. We may reassign or reclaim IPs with notice where feasible.


12.2. DNS Services

We provide DNS hosting as a convenience. DNS changes may take time to propagate and are outside our control. You are responsible for correct DNS configuration of third-party records.


12.3. SSL/TLS Certificates

SSL issuance depends on successful validation by the issuing Certificate Authority (CA). We are not responsible for delays or failures caused by CA validation issues or incorrect CSR/domain control.



13. Software Licensing and Third-Party Services

- Some Services rely on third-party software and licenses (e.g., cPanel/WHM, CloudLinux). Availability may depend on those providers.
- Third-party services are provided 'as is.' We are not responsible for their functionality, reliability, or security.


14. Intellectual Property; Client Content

14.1. Our IP

All software, branding, designs, know-how, and technology used to provide the Services are proprietary to Oysten Host Ghp or its licensors. No rights are granted except as expressly stated.


14.2. Your Content

You retain ownership of your content. You grant us a limited, worldwide, non-exclusive license to host, transmit, cache, and display your content solely to provide the Services.


14.3. Feedback

Any feedback you provide may be used by us without restriction or compensation.



15. Privacy and Data Protection

- Our Privacy Policy explains how we collect, use, and protect personal data. By using the Services, you consent to such processing, including transfers outside your jurisdiction as permitted by law.
- You are responsible for lawful processing of personal data you store or process via the Services, including providing necessary notices and obtaining consents.


16. Warranties and Disclaimers

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA LOSS WILL NOT OCCUR.


17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OYSTEN HOST GHP, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL). OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES DURING THE ONE (1) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.


18. Indemnification

You agree to defend, indemnify, and hold harmless Oysten Host Ghp, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the Services; your content; your breach of this Agreement or law; or your violation of any third-party rights.


19. Legal Compliance, Government Requests, and Export

- You must comply with all applicable laws and regulations.
- We may disclose account information to law enforcement or regulators in response to lawful requests.
- You represent that you are not on any sanctions or restricted party lists and will not use the Services in sanctioned countries or for prohibited end uses.


20. Reseller Terms (If Applicable)

- Resellers are the merchant of record for their customers and must provide primary support to them.
- Resellers must maintain accurate WHOIS for domains resold and ensure compliance with ICANN policies and this Agreement.
- We may contact end users directly in case of security, abuse, or legal issues.


21. Force Majeure

We shall not be liable for delays or failures due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil disturbances, labor disputes, supply chain failures, utility or internet outages, data center incidents, or governmental actions.


22. Changes to Services and to this Agreement

- We may modify, discontinue, or deprecate features or Services with notice where feasible.
- We may update this Agreement at any time. The updated version will be posted on our website and becomes effective upon posting, unless a later effective date is indicated. Your continued use constitutes acceptance of the updated terms.


23. General Provisions

23.1. Refusal of Service

We reserve the right to refuse, cancel, or suspend any Service at our sole discretion.


23.2. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.


23.3. No Waiver

Our failure to enforce any provision is not a waiver of our rights.


23.4. Assignment

You may not assign or transfer this Agreement without our prior written consent. We may assign in connection with a merger, acquisition, corporate reorganization, or sale of assets.


23.5. Survival

Sections that by their nature should survive termination (including but not limited to fees, IP, warranties, limitation of liability, indemnification, governing law) shall survive.


23.6. Entire Agreement; Order of Precedence

This Agreement, together with the AUP and Privacy Policy, constitutes the entire agreement between you and us regarding the Services and supersedes all prior or contemporaneous agreements. In the event of a conflict, this Agreement prevails unless expressly stated otherwise.


23.7. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of India. The courts in Lakhimpur Kheri, Uttar Pradesh, India, shall have exclusive jurisdiction over any dispute arising from or related to this Agreement.


23.8. Language

This Agreement may be provided in multiple languages. The English version controls in the event of any inconsistency.
